AND NOW...IDIOTS
Off the top of my head, I'd say for the same reason why this is covered by the First Amendment even though you didn't hand write it on a piece of paper and tack it to a church door.
I suppose that if the 2nd Amendment had been penned during the Stone Age, he would think that we should all be constrained to bashing each other with rocks.
This is truly amusing, coming from someone who almost certainly is part of the "living Constitution" faction as to every other issue. Dude, you can't eat your cake and have it.

Uuh, no. They were armed with the same Brown Bess muskets that the regulars carried.

There are no subjects that reveal the parochial idiocies of our governing and courtier classes quite like religion and firearms.
By his logic, freedom of the press shouldn't apply to what appears on smartphones.
